Terms and Conditions

The basis of the friendly atmosphere is the jointly accepted set of rules. The conditions and rules for using the services - in brief.

F&M GENERAL TERMS AND CONDITIONS

These general terms and conditions (hereinafter referred to as: GTC) apply to purchases made at the F&M fitness center, the www.fandm.hu website, the F&M app, and the F&M Club interface on the SportMate app in the business premises and on the interfaces operated by Fájdalom-ambulancia Kft. (registered office: 1123 Budapest, Csörsz utca 14-16.; cjsz.: 01-09-729362; registration authority: Court of Companies of the Metropolitan Court; tax number: 13322946-2-43; hereinafter referred to as: F&M Center).

This document regulates the legal relationship between F&M Center and customers/users (hereinafter referred to as: Users), as well as the rights and obligations of the parties. By purchasing, the User acknowledges these GTC and accepts their binding force.

The website is hosted by ITD Informatikai Zrt. (3928.Tiszatardos. Kossuth Lajos út 45. 25978348-2-05) and Kütyüszervíz Bt. (1222. Budapest, Gyár utca 13. 25018341-1-43).

The application and the Club application interface are operated by SportMate Club Kft. (registered office: 9081 Győrújbarát, Veres Péter utca 22/C. 2.; cjsz.: 08-09-029995; contact(s): support@sportmateclub.com).

Using services

The services of the F&M Center can only be used after registration, which can be done in person at the reception, on the F&M application, and via the F&M Club interface of the SportMate App. The user must also confirm their registration by email, by clicking on the link in the automatically sent email.

The services of the F&M Center can only be used in person and via online interfaces. We do not accept reservations or season ticket orders via email, telephone, or Facebook message.

By using the services of F&M, and in the case of personal or online purchases, the User automatically accepts these terms and conditions (as well as the annexes specified in point 8), based on which a contract is concluded between the User and the F&M Center.

Online shopping (Website, F&M app, SportMate app-F&M Klub, webshop)

On the online platforms of the F&M Center, you can purchase tickets and passes for fitness-wellness services, as well as top up your membership card balance to purchase additional services and products in the fitness center.
The contract concluded within the framework of online shopping is concluded in Hungarian and does not qualify as a written contract. F&M does not file the contract in printed form, it stores the orders electronically for the period according to the accounting regulations. The user has the right to request information about the orders he has placed.

The F&M Center informs its customers that 45/2014. (II. 26.) Government Decree, in accordance with Section 29 (1) l), users do not have the 14-day right of withdrawal under the regulation in connection with the purchase of tickets and season tickets, given the fact that a deadline or cut-off date has been set for the purchase of tickets and season tickets.

Purchase process in the F&M / Sportmate applications

The user can purchase on the platform after registering and logging in via email. The user can immediately purchase the product they want to purchase. The user selects the product they want to purchase in the application, which immediately starts the payment process after the selection.

After placing the order, it is possible to pay with a bank card through the Viva Wallet system, to which the user will be automatically redirected.

After payment, the user will be redirected back to the F&M platform. In case of successful payment, an automatic confirmation will be sent to the User and the given product will be credited to the User’s F&M balance/card. After the purchase, the User will receive an automatic confirmation at the email address provided.

Rentals are also available in the application with automatic renewal. Automatic renewal (when the rental expires, the application validates a new rental identical to the previous one for the User and the Viva Wallet payment system automatically deducts the price of the next rental) must be enabled at the time of the first purchase.

Automatic renewal/installment payments can be managed in the application menu. Bank card data is not stored by the F&M application, only by the payment service provider (Viva Wallet).

If you do not receive an email confirming the purchase, please check the SPAM folder of your email account, if the confirmation email is not found there either, please contact us.

The contract concluded in the framework of online shopping is not considered a written contract.

Balance top-up process in the F&M / Sportmate applications

In the case of balance top-up, you enter the amount you wish to top-up in the menu and then start the payment. After placing the order, it is possible to pay with a bank card through the SimplePay system, to which the User will be automatically redirected.

After payment, the User will be redirected back to the F&M interface. In the event of successful payment, an automatic confirmation will be received for the User and the given product will be credited to the User’s F&M balance/card. After the purchase, the User will receive an automatic confirmation at the email address provided.

If you do not receive a confirmation email, please check your SPAM folder in your email account. If you do not find the confirmation email there, please contact us.

Shopping process in the webshop

Registration is not required to start shopping (only later, at checkout).

Select the desired product and enter the name of the person who will use the given service (if giving as a gift, this is the name of the recipient, if buying for yourself, your own name). Place the desired products in the cart!
You must log in to complete the purchase. If you are not yet registered in our webshop (this is a user profile independent of the application), please do so on the page ( https://fandm.hu/fiokom/).

After logging in, you can proceed to the page https://fandm.hu/penztar/ and enter your billing information. Then, after accepting the GTC, by clicking the Submit Order button, the User will be automatically redirected to the SimplePay payment interface.

After payment, the User will be redirected back to the F&M interface. In case of successful payment, an automatic confirmation will be received for the User and the given product will be credited to the User’s F&M balance/card. After the purchase, the User will receive an automatic confirmation at the email address provided.

Right of withdrawal

The user has the right of withdrawal within 14 days of the purchase in accordance with Act 45/2014. (II. 26.) Government Decree, except in the following cases:

  • in the case of a contract for the provision of services, after the performance of the entire service, if the undertaking has started the performance with the express prior consent of the consumer and the consumer has acknowledged that he will lose his right of withdrawal after the performance of the entire service;
  • in the case of a product or service whose price or fee cannot be influenced by the undertaking and is subject to possible fluctuations in the financial market during the withdrawal period;
  • in the case of a non-prefabricated product that was produced on the instructions of the consumer or at his express request, or in the case of a product that was clearly tailored to the consumer;
  • in the case of a perishable product or a product that retains its quality for a short time;
  • in the case of a sealed product that cannot be returned after being opened after delivery for health or hygiene reasons;
  • in the case of a in respect of a product which, by its nature, is inseparably mixed with another product after delivery;
  • in respect of an alcoholic beverage whose actual value depends on market fluctuations in a way that cannot be influenced by the undertaking and the price of which was agreed upon by the parties when concluding the sales contract, but the contract is only fulfilled after the thirtieth day following its conclusion;
  • in the case of a business contract where the business contacts the consumer at the express request of the consumer for the purpose of carrying out urgent repair or maintenance work, such as the sale and purchase of a copy of computer software, if the consumer has opened the packaging after delivery;
  • in the case of a newspaper, magazine or periodical, with the exception of subscription contracts;
  • in the case of contracts concluded at a public auction;
  • in the case of a contract for the provision of accommodation, other than a residential service, transport, car rental, catering or a service related to leisure activities, if a specific performance deadline or time limit has been stipulated in the contract;
  • in the case of the sale and purchase of sealed audio and video recordings and copies of computer software, if the consumer has opened the packaging after delivery;
  • in the case of newspapers, magazines and periodicals, with the exception of subscription contracts;
  • in the case of contracts concluded at a public auction;
  • in the case of contracts for the provision of accommodation, except for residential services, transport, car rental, catering or services related to leisure activities, if a specific performance deadline or time limit has been stipulated in the contract;
  • in the case of digital content provided on a non-tangible data carrier, if the business has started the performance with the consumer’s express prior consent and the consumer has simultaneously declared his acknowledgement that he will lose the right of withdrawal after the start of the performance right.

F&M card

From 2020.05.13, it is mandatory to purchase an F&M card (hereinafter referred to as the card) to enter the F&M Center area. Without this card, entry to the area outside the reception area of ​​the fitness center is not possible. The card fee is 3000,- HUF.

If a guest leaves their card or forgets it at home, they are required to purchase a replacement or temporary card to enter. If the guest returns the card they left at home or thought to have been abandoned at the reception of the F&M Center, the fee paid for the replacement or temporary card will be credited to the guest’s balance. The card is intended exclusively for the registered person and is not transferable to anyone else. The card holder is responsible for any misuse of the card.

Guests with a valid day ticket or season ticket may only enter the fitness and wellness departments of the F&M Center with a card with a positive balance validated at the reception.

The user expressly acknowledges that the amount charged as a balance cannot be exchanged for cash later, pursuant to Section 29 (1) of Government Decree 45/2014. (II.26.) from the purchase. By accepting these GTC, the user expressly acknowledges and expressly waives his right of withdrawal.

Tickets, season tickets

The fees for the services of the F&M Center must be paid in advance – at the latest upon entry – in person or online via the applications. The request for a VAT invoice must be notified in advance, and the invoice issued in this way will be sent to the guest by email by F&M.

Passes can only be used within the validity period, after the expiration date, the value of unused sessions will not be refunded. Passes are issued exclusively electronically, they do not have a physical embodiment, they are assigned to the F&M card of the person holding the pass so that he can enter the fitness center area.
A pass can only be extended due to illness with a valid medical certificate, the maximum extension period is +1 week. A user can use the pass extension option a maximum of once per calendar year.

Periodic passes (weekly, one- or multi-month passes) entitle a maximum of two entries per day.

A single entry entitles the guest to a maximum of 3 hours of stay, if the guest exceeds the time frame, the system will charge a surcharge of HUF 700.

Group classes can be booked in advance via the e-mail address foglalas@fandm.hu, as well as via the F&M app and the SportMate application via the F&M Club interface. Group class bookings are only possible for guests with a valid pass. If the guest does not show up for the booked class and does not cancel the reservation, this session will be deducted from their pass. In the event of a cancellation within 3 hours before the start time of a group class, 1 session will be deducted from the pass.

Any misuse or fraud of the pass on the premises of the F&M Center will result in a police report.

Additional services

The F&M Center provides guests with a towel for a fee upon entry, which the guest is required to return upon exit and place in the collection basket located next to the reception.

F&M Center currently offers its guests the services of the wellness department free of charge, but they are not part of the basic service. F&M Center reserves the right to change this in this regard.

Virtual Gym

When purchasing an online pass through the F&M application, you can access certain video content – ​​related to group classes – during the validity period of the pass.

In the case of an online pass – given its nature based on access to digital data content – ​​the 14-day right of withdrawal cannot be exercised.
Online content is only allowed to be used by private individuals to help with their own training, and cannot be used for any other purpose – in particular, but not exclusively, it is prohibited to publish/resell/share it with third parties. The owner of the pass is not allowed to allow access to the videos to other, third parties in any way. The protection of the data required for access (login) is the obligation and responsibility of the given User.

Additional provisions

The User acknowledges that if the fitness center cannot be open for a reason not attributable to F&M (e.g. epidemiological regulations), the purchased tickets and passes are suspended in terms of their usability, and they can be used according to the usage period on the closing day when the fitness center reopens.

The User acknowledges that in the event of force majeure, F&M Center is exempt from liability for non-performance or partial non-performance of the service to the extent and duration affected by the force majeure.

F&M Center excludes liability to the fullest extent permitted by law for malfunctions or unavailability of the website or application.

Payments related to online purchases are handled by SimplePay and VIVA PAYMENT SERVICES SINGLE MEMBER

These GTC are available on the F&M website, applications, and at the reception of the F&M Center.

The user acknowledges that F&M Center is entitled to modify the website and applications, which modifications do not affect orders already placed.

F&M Center reserves the right to unilaterally amend these GTC and its annexes. In the event of any amendment, Users will be informed in advance via e-mail.
